What is BANKRUPTCY?

BANKRUPTCY is a legal proceeding that provides a fresh financial start for those who cannot pay their bills. Filing BANKRUPTCY stops creditors from collecting from the debtor.

What can BANKRUPTCY do for me?

-BANKRUPTCY can eliminate all your debts (this often referred to as "discharge" of debts)

-Stop foreclosure

-Stop repossession

-Stop wage garnishment by creditor

What property can I keep?

In Chapter 7, you can keep those that are considered "exempt" under the law. You should talk to a BANKRUPTCY attorney as to what your state considers as "exempt" property.

Can I own anything after BANKRUPTCY?

Yes, you can keep your "exempt" property and anything you acquire after you file, subject to a few exceptions.

Will I have to appear in court?

You have to appear in court at the meeting of the creditors. If your case becomes complicated, you may have to make several court appearances. You will receive notice of your court date.

Can I file BANKRUPTCY without an attorney?

While it is possible to file a BANKRUPTCY without an attorney, preparing documents to file BANKRUPTCY can be very difficult. You might lose some rights or properties from not knowing the law.

How do I find an attorney?

You should find an attorney who is trustworthy and who is able to give you personal attention. Once you start falling behind on payments, creditors will call you persistently to collect on the debt. Creditors might initiate lawsuits and wage garnishment. If BANKRUPTCY is the appropriate step to take, your attorney should be able to file your case quick. You have to be careful about those non-attorney document preparers or paralegals, as they are not able to render legal advice.

How long will BANKRUPTCY stay on my credit report?

Filing of BANKRUPTCY stay on your credit report for 10 years from the time you filed. To improve your credit, you should ensure all the debts you listed in your BANKRUPTCY filing have zero balance after you get the discharge.
